These Terms & Conditions (“Terms”) govern the services provided by Ellam Media (“we”, “us”, “our”) to you, the client (“you”, “your”). By booking or commissioning work from us, you agree to these Terms. Please read them carefully; if anything is unclear, email hello@ellammedia.co.uk before proceeding.
1. About us
Ellam Media is a video production and photography studio based in Cambridgeshire, United Kingdom. You can reach us at hello@ellammedia.co.uk or on 07823 883247.
2. Quotes & bookings
Quotes are based on the brief and information you provide and are valid for 30 days unless stated otherwise. A project is confirmed once you have accepted our quote in writing (email is sufficient) and, where applicable, paid any booking deposit. Significant changes to the agreed brief, scope, timings or deliverables may require a revised quote.
3. Fees & payment
Unless agreed otherwise in writing:
- A deposit (typically 50% of the project fee) is payable to secure your booking and shoot date.
- The balance is due on delivery of the final files, or as set out in your quote or invoice.
- Invoices are payable within 14 days of the invoice date.
- We reserve the right to charge interest on overdue amounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
- Expenses agreed in advance (e.g. travel beyond the local area, licensed music, actors, props, permits, equipment hire) are charged in addition to the project fee.
4. Cancellation & rescheduling
If you cancel a confirmed booking, the deposit is non-refundable as it covers reserved time and preparation. Cancellations or rescheduling requests made within 48 hours of a shoot may incur additional charges to cover committed costs. We will always try to accommodate reasonable rescheduling where possible.
5. Your responsibilities
To help your project run smoothly, you agree to provide accurate briefing information, timely feedback and approvals, safe and lawful access to filming locations, and any necessary permissions or releases for people, premises, brands or third-party materials that appear in the content. You confirm that any materials you supply to us do not infringe the rights of others.
6. Deliverables, revisions & timelines
The specific deliverables, formats and delivery timeline will be set out in your quote. Unless stated otherwise, projects include one round of minor revisions to the edit. Additional revisions or changes beyond the agreed scope are chargeable. Timelines are estimates made in good faith and may be affected by factors outside our control, including your feedback turnaround.
7. Intellectual property & usage rights
We retain ownership of all copyright and intellectual property in the footage, images and final content we create, including project files, raw footage and out-takes, unless a full buy-out is agreed in writing. On full payment of all sums due, you are granted a licence to use the delivered final content for the purposes agreed in your quote (for example, your website and social media channels). Raw/unedited footage and project files are not supplied as standard and may be licensed separately.
8. Portfolio & promotion
Unless you ask us in writing not to, we may showcase work we have produced for you in our portfolio, on our website and social media, and in award or marketing submissions. If your project is confidential, please tell us before we begin and we will agree suitable restrictions.
9. Music & third-party licences
Any music, stock footage, fonts or other third-party assets used in your content are licensed for the agreed use only. Extending that use (for example, paid advertising or broadcast) may require additional licensing at extra cost. You are responsible for ensuring your intended use is covered.
10. Liability
We provide our services with reasonable skill and care. Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded by law. Subject to that, our total liability arising out of or in connection with a project is limited to the total fees paid by you for that project, and we are not liable for indirect or consequential losses, or for loss of profit, business or anticipated savings.
11. Force majeure
We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including illness, adverse weather, equipment failure, or the acts of third parties. Where such an event occurs, we will work with you to reschedule.
12. Governing law
These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to these Terms
We may update these Terms from time to time. The version in force is the one published on this page at the time your project is confirmed.
